Tax ARTICLE - Massachusetts Establishes Limited Amnesty Program

Massachusetts has established a tax amnesty period between April 1, 2010 and June 1, 2010 applicable for tax periods ending on or before December 31, 2009 that is limited to sales-use taxes, withholding taxes, and certain business tax liabilities.

Under the program, notified taxpayers that pay the full amount of tax and interest due for any period as shown on the Tax Amnesty Notice will have all unpaid penalties including those imposed for failure to timely file a return, failure to file a proper return, failure to timely pay a tax liability, and failure to pay the proper amount of any required estimated tax payments for such period waived. Required payments must be received by 5:00 p.m. EDT, June 1, 2010.

However, penalties that have been assessed, or that could be assessed against a taxpayer related to any other tax types are not waived under the amnesty program. For more information please contact Feeley & Driscoll, (888) 875-9770 for questions regarding Massachusetts tax preparation; or refer to the Massachusetts Technical Information Release 10-5, 03/12/2010.
